The North Carolina Court of Appeals will hear arguments today in a case that pits a for-profit education company against the State Board of Education. At issue is how the board considered an online charter school application.
Last year, K-12 incorporated - and the non-profit it set up called NC Learns - tried an end-run around the State Board of Education’s process for approving charter schools. After the state chose not to make a decision on K-12’s online charter school application, the company convinced the Cabarrus County School Board to approve the school that could have drawn students from across the state.
That led the State School Board to sue. An administrative court judge first sided with K-12, but last summer a Wake Superior Court judge found for the State School Board.
The Appellate court will hear arguments on the case this afternoon. They are likely to center on the legality of the State School Board’s original choice to delay action on the virtual school.
