At the John Edwards trial the prosecution has rested, and today the defense is expected to ask the judge to dismiss the case all together.
Jeff Tiberii: Rule 29 is really a formality. The defense will argue the government presented insufficient evidence to sustain a conviction and that the case should be thrown out. Judge Catherine Eagles is likely to dismiss the Rule 29 motion seeking an immediate acquittal, and have the defense proceed with its case on Monday. Arguing rule 29 is a long-shot but could help with an appeal or overturning a verdict down the road, if Edwards is convicted. The argument is expected to take less than an hour.
